The Importance of Cultural Competence in Forensic Psychology

In courtrooms across America, forensic psychologists hold immense power over people’s lives. Their assessments can determine whether a defendant stands trial, receives treatment, or risks returning to prison. One misjudgment can ripple through a life forever. But in a nation where immigrants, people of color, and other marginalized groups are disproportionately swept into the justice system, cultural blind spots can make even the most careful evaluations dangerously incomplete.
The 2012 Washington State Supreme Court case State v. Sisouvanh brought that reality into sharp focus. The ruling served as a wake-up call: in the delicate balance of justice, cultural competence isn’t just a professional courtesy. It can mean the difference between fairness and a flawed verdict.
What Is Cultural Competence?
Cultural competence is an ongoing commitment to understanding how factors like race, ethnicity, language, religion, immigration history, and sexual orientation shape a person’s worldview, behavior, and mental health. It requires self-awareness of personal biases, knowledge of sociocultural contexts, and the flexibility to adapt assessment practices.
The American Psychological Association’s guidelines frame it as an ethical duty to prevent harm and promote equity in mental health services, including forensic settings. Effective training often involves active learning (role-playing, discussions, and self-reflection) to build these skills over time.
When Culture Meets the Court
In 2012, the Washington State Supreme Court heard State v. Sisouvanh, marking the first time an appellate court explicitly demanded cultural competence in competency-to-stand-trial evaluations.
Phiengchai Sisouvanh, a Laotian immigrant convicted of aggravated first-degree murder, challenged her court-ordered competency assessment. She argued that the evaluator, Dr. Randall Strandquist, lacked sufficient cultural expertise to interpret her responses accurately, relying instead on Western-based tools like the Personality Assessment Inventory (PAI) without fully accounting for her Laotian background.
The court ultimately upheld the conviction, finding the evaluation reasonable given Sisouvanh’s long-term acculturation to American society. However, it emphasized that cultural factors must be considered when they could affect understanding of legal proceedings or communication with counsel.
This ruling set a precedent, highlighting how overlooking cultural context can undermine the validity of forensic opinions and reinforced the need for evaluators to demonstrate cultural humility.
The Role of Cultural Competence in Forensic Settings
Cultural competence ensures evaluations are accurate and equitable. In competency assessments, risk predictions, and asylum cases, ignoring cultural nuances can lead to misdiagnoses (such as interpreting cultural expressions of distress as symptoms of psychosis) or inflated risk scores. Best practices include using qualified interpreters, culturally sensitive tools, collateral information from the individual’s community, and tailored rapport-building. These steps not only enhance reliability but also help reduce disparities, particularly for overrepresented groups like people of color and immigrants.
Challenges, Culture, and the Modern Practice of Forensic Psychology
Today’s forensic psychologists face a complex web of challenges, particularly in applying cultural competence within the justice system. Systemic biases remain pervasive, from the overrepresentation of Black, Indigenous, and other marginalized communities in courts to the limitations of standardized assessment tools normed primarily on White populations. Implicit biases can skew diagnoses (for example, mood disorders in Black clients may be mislabeled as psychosis) or inflate perceived risk of violence.
The field also struggles with a lack of diverse practitioners, insufficient training, and institutional barriers to resources like interpreters. The rise of algorithmic risk assessments has further complicated matters, often embedding racial disparities into ostensibly “objective” tools. Forensic psychology now wrestles with the tension between evidence-based methods and the relational, bias-aware approach demanded by cultural humility, a tension that calls for ongoing reform.
These challenges are inseparable from broader cultural and political currents. In a polarized climate, debates over criminal justice reform, immigration, and racial equity frequently cast a spotlight on forensic evaluations. High-profile cases, where cultural misunderstandings spark public outrage, underscore how evaluations can either reinforce harmful stereotypes or promote fairness and restorative justice.
Media coverage amplifies this impact, sometimes sensationalizing so-called “cultural defenses” or critiquing systemic bias. As movements like Black Lives Matter bring disparities to the forefront, forensic psychologists occupy a pivotal role: bridging cultural divides, informing policy, and shaping public understanding of accountability, rehabilitation, and justice.
Toward a More Equitable Future
The Sisouvanh case serves as a wake-up call: cultural competence is vital for ethical, accurate forensic practice. By embracing humility, seeking diverse perspectives, and advocating for systemic change, forensic psychologists can help build a justice system that truly reflects America’s diversity. The path forward requires commitment from practitioners, training programs, and policymakers alike.
